  • Incident: On 6th of August 2020, a production worker at E & J International Pty Ltd, a food processing company, suffered partial amputation of two fingers when the blade of a Four Roll Meat Slicing Machine descended while she was attempting to remove material from the rear of the machine. The machine lacked proper safeguarding, and the worker’s hand was caught in the moving parts.
  • Investigation: Following a SafeWork NSW investigation, it was found that the company had breached its obligations under the Work Health and Safety Act 2011 (WHS Act), specifically Section 32/35(2), which requires employers to ensure the health and safety of workers by providing safe systems of work and safeguarding plant and machinery.
  • Penalty: On 15th December 2023, the company was convicted by the District Court and fined $262,500 for failing to adequately safeguard the machinery, which directly contributed to the worker’s injury.

  • Incident: An engineering company was fined after a worker sustained fatal injuries while operating a lathe machine. The worker was fatally injured when they became caught in the unguarded rotating parts of the lathe. The investigation found that the company had failed to properly safeguard the machinery, leading it exposed to workers’ access to moving parts, which led to the tragic incident.
  • Investigation: SafeWork NSW investigated and found the employer in breach of its duties under the Work Health and Safety Act 2011 (WHS Act). Specifically, the company failed to ensure that the plant was safe to operate and did not install adequate guards to protect workers from moving machinery parts.
  • Penalty: The engineering company was fined $1.4 million for failing to comply with safety regulations and not safeguarding the machinery, resulting in a fatality.

  • Incident: On the 7th of December 2017, a 42-year-old contractor working for Buddco Pty Ltd was tragically fatally injured when he became trapped by an anchor blade inside an industrial ink holding tank while cleaning it at the company’s facility in Auburn. Two other workers were seriously injured as they attempted to assist the trapped contractor.
  • Investigation: SafeWork NSW investigated the incident and found that the company had failed to ensure the safety of its workers when cleaning hazardous equipment. The investigation revealed that Buddco Pty Ltd had not implemented proper risk control measures to prevent access to the hazardous parts of the machinery, which directly contributed to the fatal injury.
  • Penalty: Following a defended hearing, the defendant was convicted under Section 32/19(1) of the Work Health and Safety Act 2011, which requires employers to ensure the health and safety of workers while they are at work. On 2 May 2023, Buddco Pty Ltd was fined $600,000 for failing to comply with safety standards and inadequate risk management in safeguarding the machinery.
